Consumer Terms and Conditions

The following terms cover a consumers rights or provisions under Online and Distance Selling.

If you are ordering on behalf of a company please refer to our Trade Terms.

This document sets out details of the additional rights you have when buying as a consumer. It also provides the information we are required to provide to you in accordance with The Consumer Contracts Regulations(Information, Cancellation and Additional Charges).

The Consumer Contracts Regulations apply to both goods and services, where the contract is made between a supplier (a seller acting in the course of a business) and a consumer (a non-business buyer) and there is no face-to-face contact between them.
A consumer is a natural person who is acting for the purposes other than those of his trade, business or profession or acting as a representative of his employer. Orders including or being represented as a company name will be deemed to be a trade customer and Trade Terms will apply.

Do these rights apply to my purchase?

Certain goods and services are exempt from all or part of the Regulations.
These are as follows:
Business-to-business contracts;
Products which are made to order/special order;
Financial services sold at a distance (However, these are covered by the Financial Services (Distant Marketing) Regulations);
Contracts for the sale of land;
Products bought from vending machines;
Goods or services bought at an auction with an auctioneer.

Payment for goods can be made using credit/debit card, Paypal or bank transfer.

Goods will normally be dispatched within 2-3 days if it is a stock item.
Seats, suspension kits and brake hoses are 'made to order' as special orders and may take longer.
Please allow up to 28 days, we will normally keep you informed if orders take a longer time than expected.

The right to cancel does not apply to contracts for the sale of the following goods:
Goods which are 'made to order' for purchase by that particular customer;
Perishable goods, for example fresh food and flowers;
CDs, DVDs and tapes once the packaging has been unsealed;
Newspapers and magazines;
Betting, gaming and lotteries.

These rights only apply if you are buying goods and/or services from us as a consumer.

Information about goods and services:
A full description of the goods and services you are buying is set out on the website. Please contact us if you would like any further information or if you have any queries about such descriptions. Where we are supplying goods, we have a legal obligation to ensure that the goods supplied meet the description we have provided to you.

Price and payment method:
The price of goods and services ordered by you, along with appropriate payment methods, will be calculated and provided to you prior to placing your order.

Goods are normally provided with a one year manufacturers’ guarantee, unless otherwise stated. We will let you know if this applies to goods you have purchased from us.

Termination and Minimum Terms: Details of minimum terms and the termination arrangements for each service are detailed on our website and will be confirmed to you prior to placing your order.

Some of our services have a minimum term and you will be charged to the end of that minimum term if you terminate your contract before it expires. We will make you aware of this if it applies to your service.

Right to cancel - General:
You have a right to cancel your contract within 14 days without giving any reason.

To exercise the right to cancel, you must inform us, K300 Limited, of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Right to Cancel - Goods:
For sale of goods, the cancellation period will expire after 14 days from the day on which you acquire (or a third party other than the carrier and indicated by you acquires) physical possession of the goods supplied.

Right to Cancel – Services:
For services, the cancellation period will expire after 14 days from the day of the conclusion of the contract (i.e. when we accept your order).

If you ask us to commence the services before the 14 day period has ended, your right to cancel ends, even if you have not started using the service provided.

If you cancel a service before we provide it, you may have to pay for any work that has been done towards providing the service.

Effects of cancellation - General:
If you cancel your contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than-

(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Effects of cancellation - For goods:
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Effects of cancellation - For services If you request to begin the performance of services during the cancellation period you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract (this applies only where the request to cancel the services is made before they have been fully performed).
